What Hamilton's ADU Rules Actually Allow

Hamilton is one of the more permissive cities in Ontario for additional dwelling units, but the rules have real limits and not every lot qualifies. Here is what governs your project.

Two Units Per Lot

Under Hamilton’s current ADU by-laws, most low-density residential lots inside the urban boundary can support up to two additional dwelling units. One inside the existing house, and one detached in the yard. An internal ADU is a conversion of interior space, or a new addition, bringing the property to a maximum of four dwelling units.

Size and Coverage Limits

A detached garden suite is capped at 75 square metres of gross floor area, roughly 807 square feet, not counting a garage or basement. All buildings on the lot combined, including the suite, cannot exceed 45 per cent lot coverage. The suite also cannot be larger than your main house. On a typical Hamilton mountain lot, coverage is usually the binding constraint, not the size cap.

Not Every Lot Qualifies

Lot dimensions, available parking, heritage value, and natural features on the property can all rule out a detached suite. We check this before you spend money on drawings, not after.

Heritage and Special Zones

If your property is designated heritage or sits inside a Heritage Conservation District, a heritage permit is required. Properties in the ER zone of the former Ancaster by-law and along the Hamilton Beach strip may also need a separate zoning compliance review before a building permit is issued. Given how much of Hamilton’s older stock carries a heritage designation, this comes up more often than homeowners expect.

What Drives the Cost of an ADU/Garden Suite?

Cost is decided by three things: the condition of the structure you are starting from, how far the servicing has to run from the main house, and the finishes. An existing suite that needs a kitchen, bathroom, and finishes updated sits at the low end. A garage conversion with a long utility trench and full rough-in sits at the high end.

Timeline is more predictable than cost. Permit drawings take three to four weeks to produce, and the City of Hamilton’s review typically runs one to three months. Servicing has to land between spring and late fall. Working backwards from that window is what keeps a project on schedule.

Hamilton’s $40,000 Garden Suite Grant

Hamilton’s Additional Dwelling Unit and Multi-Plex Housing Incentive Program, funded through the federal Housing Accelerator Fund, offers a grant of 70 per cent of eligible costs to a maximum of $40,000 per eligible unit, paid in two parts. The first advance is 20 per cent of the estimated total, up to $8,000, with the balance following occupancy. Detached garden suites are an explicitly eligible project type. Eligibility depends on your property falling inside the Housing for Hamilton Community Improvement Project Area, so the location check matters. 

The grant applies to work that creates a new dwelling unit and requires a building permit, which means a garage conversion can qualify while an update to an already legal suite generally will not. The application goes in alongside your building permit, which means the sequencing has to be right from the start.

Feasibility and Lot Assessment

Before anything else, we walk the property and check it against the zoning that applies to your specific lot. Coverage, setbacks, parking, servicing routes, and any heritage or natural feature constraints. You get a clear answer on what your lot can hold before you commit to a design.

Design and Permit Drawings

We coordinate the architectural, mechanical, and structural drawings your permit application needs, and we review them for constructability while they are being produced rather than after. Catching a problem on paper is far cheaper than catching it in the ground.

Servicing and Utility Connections

Water, sanitary, and electrical have to be trenched from the suite back to the main house and tied into existing services. This work is weather-dependent in Hamilton and generally has to happen between spring and late fall while the ground is workable, which drives the whole project schedule.

Garage Conversions

If you already have a detached garage with a sound foundation, converting it is often the fastest route to a legal suite. Alongside exterior renovations, we frame the interior layout, run the rough-in, insulate to code, and finish it as a complete dwelling.

Existing Suite Renovations

Plenty of Hamilton properties already have a suite that no longer works. Dated kitchens, bathrooms with failing waterproofing, poor ventilation, layouts that made sense for a tenant but not for a parent. We renovate the unit you have rather than starting over, which is almost always the better return on a space under 800 square feet.

Internal Suites and Additions

Not every property suits a detached suite. Where the lot will not take one, a self-contained unit inside the house is often the better answer, and a finished basement with its own entrance, kitchen, and bathroom can deliver the same result for less.

Accessible and Aging in Place Design

Curbless showers, wider doorways, and structural blocking behind bathroom walls cost very little to include during a renovation and are expensive to add later. If the suite is for a parent, we plan this in from the start.

Kitchen, Bathroom, and Interior Finishes

The suite gets the same standard as the main house. Schluter Systems waterproofing with Power Grout in the bathroom, flood tested before tile goes down. Riobel shower valves, Gerber Avalanche toilets, and Panasonic Whisper ventilation, which matters more in a small unit than a large one.

How big can a garden suite be in Hamilton?

A detached additional dwelling unit is limited to 75 square metres of gross floor area, about 807 square feet, excluding a garage or basement. It also cannot be larger than your main house, and all buildings on the lot together cannot cover more than 45 per cent of the lot.

Can I build a garden suite on any lot in Hamilton?

No. Lot size and dimensions, parking requirements, heritage designation, and natural features on the property can all disqualify a lot. A lot assessment is the first step, before any design work.

What is the difference between a garden suite and an ADU?

It depends on the scope. Structural changes, plumbing relocation, and electrical upgrades require a building permit, and converting an existing garage into a dwelling unit requires one as well, along with a water service upgrade permit depending on the servicing. Designated heritage properties require a heritage permit on top of that.

Is it cheaper to convert a garage or renovate an existing suite?

Renovating a suite that is already legal is almost always less expensive, because the servicing, structure, and permits are in place. A garage conversion costs more but creates a unit that did not exist before, and it may qualify for the City’s incentive program. We assess both during the lot review.
